1. Acceptance of Terms
By accessing or using the Aimcatch website or application (the “Service”), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use the Service.
2. Use at Your Own Risk / Disclaimer of Warranties
The user expressly acknowledges and agrees that use of the Service is at the user’s sole risk. To the maximum extent permitted by applicable law, the Service and any services performed or provided through the Service are provided on an “AS IS” and “AS AVAILABLE” basis, with all faults and without warranty of any kind.
Aimcatch disclaims all warranties and conditions, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third-party rights. No oral or written information or advice given by Aimcatch or its authorized representatives shall create a warranty.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on statutory consumer rights. In such cases, the above limitations may not apply to you.
3. User Accounts and Conduct
Aimcatch may allow users to create accounts or sign in using third-party authentication services. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
Aimcatch reserves the right, at its sole discretion, to suspend, restrict, or terminate any account at any time, including in cases of misuse, abuse, misconduct, or violation of these Terms.
4. User Content and Ownership
Users retain ownership of all images and other content they upload to the Service.
By uploading content, you grant Aimcatch a limited, non-exclusive, non-transferable license to store, process, and display such content solely for the purpose of operating and providing the Service.
Aimcatch does not use uploaded images for advertising, marketing, or promotional purposes.
5. Image Storage, Access, and Confidentiality
Uploaded images are stored on Aimcatch’s systems to enable the functionality of the Service. Images are not publicly published or shared with other users.
Access to uploaded images is limited to the user and authorized Aimcatch personnel only when necessary, such as for technical support, system maintenance, security investigations, or abuse prevention.
6. Image Retention and Deletion
Images are retained only for as long as necessary to operate the Service. When a user reaches the maximum storage limit of 500 images, older images may be automatically deleted.
Images may also be periodically deleted as part of system maintenance or data minimization practices. Deleted images may not be recoverable.
7. Security
Aimcatch implements reasonable technical and organizational measures designed to protect user data and uploaded content. However, no system can be guaranteed to be completely secure. Users acknowledge that digital storage and transmission involve inherent risks.
8. Third-Party Authentication and Security Services
Aimcatch offers login via Google Sign-In and uses Google reCAPTCHA to help prevent abuse and unauthorized access.
These services may process certain technical and authentication-related data in accordance with their own privacy policies. User-uploaded images and content are not shared with these services.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Aimcatch shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to the use of or inability to use the Service.
10. Governing Law
These Terms are governed by applicable law. Nothing in these Terms limits mandatory consumer rights that cannot be waived under applicable law.
